David is a founding member of Niesen | Price | Worthy | Campo, P.A., which evolved from a previous firm he founded, The Robertson Group, P.L. For over 30 years, David has devoted his practice almost exclusively to the area of construction law and litigation.
David is licensed to practice law in the state and federal courts of both Florida and Georgia, and has been admitted, pro hac vice, to various other states’ courts and to tribal court. He has been Florida Bar Board Certified in Construction Law since August 1, 2005, and a Florida Supreme Court Certified Civil Circuit Mediator since 2015.
David has considerable experience in jury and non-jury trials, in both state and federal courts, as well as arbitrations before privately-appointed panels and panels appointed under the American Arbitration Association rules. In addition, David has prosecuted and defended appeals at the District Court of Appeal and Circuit Court of Appeal levels. Though David’s practice continues to focus on construction-related matters involving complex litigation, he also has considerable experience handling cases involving business and contract disputes, and administrative licensing disputes. In that regard, David handles a wide range of construction-related matters and disputes including: construction liens, contract disputes, defect claims, delay claims, payment and collection disputes, bond claims and insurance disputes. He has even provided expert testimony in complex litigation cases regarding attorneys’ fees and costs awards.
Throughout his career as a construction attorney, David has represented, and been opposed to, contractors, subcontractors, suppliers, sureties, design professionals, county and city governments, federal and state agencies and departments, and residential and commercial private owners. He is often retained to take a proactive role and represent clients at the forefront of an upcoming project, where he will be involved in drafting and negotiating construction contracts for every aspect of a project. Even when a dispute cannot be avoided, David recognizes the time and cost of litigating a dispute through trial, so he evaluates and discusses with his clients the case issues and options from the start, and throughout the course, of the dispute as new information is learned and events unfold, so that the client has objective and up-to-date information to “make a good business decision.”
David also maintains certification by the Florida Department of Business and Professional Regulation, Construction Industry Licensing Board as an instructor for continuing education to those licensed in the construction industry for more than 25 years, having created and taught courses covering topics like contracting, lien law, bond law, licensing and delay claims, to thousands of attendees throughout Florida.
